§ 44-2. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Bulk container means a metal container of not less than four cubic yards capacity, nor larger than eight cubic yards capacity, constructed so as to be watertight, but with drain plugs at the lowest point of the container to facilitate the drainage of any liquids that might accumulate in the container. Bulk containers shall be furnished by the owner or occupant of the establishment.

    Commercial establishment means any hotel, motel, roominghouse, apartment house, and a business, industrial, public or semipublic establishment of any nature or kind whatsoever, other than a single dwelling unit, residential unit or condominium.

    Commercial refuse means all solid waste originating in businesses and multifamily dwellings. The term includes, but is not limited to, office buildings, apartment houses, condominiums, stores, food service establishments, theaters and privately owned hospitals and other institutional units.

    Condominium means individual ownership units in a multifamily structure with a front and back entrance to each such unit on the ground level.

    Construction demolition wastes means waste materials resulting from the construction or razing of buildings, structures and/or pavements. The term includes, but is not limited to, lumber, paper, plaster and concrete.

    Disposable container means a nonreusable, watertight container constructed of plastic, paper or other material as approved by the director of sanitation and used for the storage of solid waste materials.

    Garbage means all wastes resulting from the handling, storage, preparation, cooking, sale or serving of food. The term includes, but is not limited to, vegetable wastes, animal offal, animal excretions, carcasses of dead animals and food wastes. The term, however, does not include human waste.

    Hazardous wastes means hazardous wastes of a solid, liquid or gaseous nature, including hot ashes, pesticides, sewage sludges and chemicals which, by reason of their pathological, explosive, radioactive or toxic nature may cause injury or illness to collection and/or disposal personnel.

    Independent contractor is a natural person, business, or corporation that is in the business of providing goods or services to another entity under terms specified in a contract or within a verbal agreement.

    Industrial waste container means any container such as a metal box, bucket, an open bed container or special container used for transporting chemicals, paint, metals, glass, oil products, plastics or any type of material that requires special handling.

    Junk means any appliance, large household item or vehicle, except a motorized vehicle, that is discarded or is no longer operative.

    Landfill means a method of disposing of solid wastes, other than putrescible wastes or hazardous wastes, on land by placing an earth cover thereon.

    Litter means that visible portion of solid waste which is discarded outside of the regular storage and disposal system.

    Mobile container means a plastic, waterproofed, wheeled refuse container with 32-gallon or 96-gallon minimum capacity furnished by the city for residential collection.

    Multiple dwelling means a building designed for and containing three or more dwelling units.

    Putrescible wastes means wastes that are capable of being decomposed by micro-organisms. The term includes, but is not limited to, kitchen wastes, animal wastes, offal, hatchery and poultry wastes, and garbage.

    Refuse means garbage, rubbish and commercial refuse.

    Residential unit means any freestanding structure or shelter or any part thereof used or constructed for use as a residence for one family.

    Rubbish/trash means any nonputrescible item of solid waste. The term includes, but is not limited to, the following kinds of material:

    (1)

    Combustible materials such as paper, cardboard, wood, yard trimmings, excelsior and furniture; and

    (2)

    Noncombustible materials such as metal cans, glass, crockery and appliances.

    Sanitary landfill means a method of disposing of putrescible, nonputrescible and/or hazardous wastes on land by placing an earth cover thereon.

    Solid waste means all putrescible and nonputrescible wastes, except water-carried human body wastes. The term includes, but is not limited to, garbage, rubbish, trash, ashes, industrial wastes, residue from incineration, junked motorized vehicles, demolition wastes, construction wastes, junk, hazardous wastes and any other waste material in a solid or semisolid state not otherwise defined in this article.

    Solid waste container means disposable containers, nondisposable containers, bulk containers and/or volume-reducing equipment meeting the specifications as set forth in this article.

    Transfer station means a facility used to transfer solid waste from one transportation vehicle to another for transportation to a disposal facility.

    Unauthorized accumulation of solid wastes means the storage or accumulation of solid waste on any premise in the city that:

    (1)

    Creates unsanitary conditions as determined by the county department of public health;

    (2)

    Creates fire hazards as determined by the city fire department;

    (3)

    Causes offensive or obnoxious odors;

    (4)

    Provides a breeding or harboring place for insects or vermin; or

    (5)

    In any way adversely affects the health, safety and welfare of the public as established by the appropriate and applicable standards of the city.
