Chapter 44. SOLID WASTE MANAGEMENT |
Article I. IN GENERAL |
§ 44-4. Administration and enforcement of chapter.
(a)
The director of public works shall be responsible for the administration and enforcement of the provisions of this chapter. He may call upon the chief of police and the county director of public health for assistance in its enforcement. All regulatory actions of the director of public works shall be subject to review and approval by the city manager.
(b)
The director of public works or his designee shall have the authority to make routine inspections of commercial bulk containers, residential containers and collection areas to determine the serviceability or sanitary condition of each. If the garbage containers or collection areas are found to be unserviceable, in poor condition, hazardous to collection personnel or in an unsanitary condition, the director of public works shall have the authority to condemn such containers or collection areas and give written notice by registered letter to the owner or occupant. The owner or occupant shall have 15 days from the date of the letter to abate the existing condition. Upon failure to abate the existing condition, the city shall remove any condemned containers or otherwise abate the existing condition and shall charge the expenses thereof to the owner or occupant of the premises.
(c)
The director of public works and any police officer shall have the authority to enforce all of the provisions of this chapter and shall issue a citation to any violator of any provision of this chapter.
